Wavvy Beam — Terms of Use

1. About These Terms

These Terms of Use ("Terms") are an agreement between you and Rize Teknoloji, based in Rize, Türkiye ("we", "us"). They govern your use of the Wavvy Beam app on phones, tablets, Android TV and other devices, and of its related services, such as cloud sync, sending to Wavvy TV Plus and the data deletion page (together, the "App").

By installing or using the App you agree to these Terms. If you do not agree, do not use the App.

Our Privacy Policy explains how we handle personal data and forms part of these Terms. Our Copyright Policy explains how we handle copyright complaints.

These Terms are also published in Turkish further down this page. In the event of any discrepancy, the Turkish version prevails, unless the law of your country requires otherwise.

2. Trademarks and Non-Affiliation

Chromecast, Google Cast, Android TV and Google TV are trademarks of Google LLC. Samsung, LG, Sony are trademarks of their owners. Wavvy Beam is not affiliated with, endorsed or sponsored by Google, Samsung, LG or Sony.

These names appear in the App, in its store listing and on our website only to describe compatibility, for example "works with Chromecast". They are not part of our product name or logo. Other names of devices, formats, codecs, protocols, servers and websites belong to their owners, and their appearance does not mean we are affiliated with or endorsed by them.

3. What the App Is — and Is Not

Wavvy Beam is a casting tool and TV remote. It lets you:

Send ("cast") your own videos, music and photos, and web links and playlists you choose, from your phone or tablet to Chromecast and other Google Cast devices, to DLNA/UPnP smart TVs, and to our Wavvy TV Plus app
Find video and audio on web pages in the in-app browser so that you can cast them
Control an Android TV or Google TV with buttons, keyboard and voice
Play media on the device itself

What the App is not:

The App provides no content. It contains no films, series, channels, playlists, catalogs or built-in streams, and it does not help you find content.
We do not host, upload, sell or control any media. Files are shared from your phone to your TV over your own local network, and web links are loaded by your TV from the website that offers them. Nothing passes through our servers.
The in-app browser does not download media and does not bypass copy protection (DRM) or access controls. YouTube is not supported.
The TV remote uses your TV's own remote control protocol. It is not an official Google product, and your TV's maker may change that protocol in an update.
Paying for Pro pays for features of the App. It does not buy any film, series, channel or other content.

4. Your Content and Lawful Use

You alone are responsible for the files, links, playlists, subtitles and network sources you cast or open with the App. You agree to:

Cast only content that you own or have the right to watch and show, and follow the terms of the websites and services you use
Not use the App to show content publicly, for example in a shop, bar or event, unless you hold the necessary rights and licences
Connect only to TVs, Cast devices, network shares and servers that you own or are authorized to use
Follow the copyright and other laws that apply where you live
Not use the App to gain access to devices, servers or networks without permission

5. Eligibility, Accounts and Security

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the App. If you are under the age of majority where you live, you need a parent's or guardian's permission, particularly to make purchases.
You can use the App as a guest (an anonymous account is created automatically) or sign in with Google to sync profiles and network sources across devices.
The kids profile setting helps parents organise what is shown on their own device. It is not a parental-control or content-filtering service, and you remain responsible for what children watch.
You are responsible for activity on your account and for keeping your device, Google account, server credentials and Wavvy TV Plus sign-in details secure.
While casting, the App shares the files you chose on your local network through random addresses. Casting, DLNA and some network protocols are not encrypted; use them on networks you trust. Protecting your network and devices is your responsibility.

6. Free Trial, Free Version, Pro and Payments

Free trial. New installs get 7 days of full Pro access. No payment card is needed and nothing is charged when the trial ends. The App shows how much of it is left. The trial is tied to the device and to your account, so it does not restart after reinstalling the App.

Free version. After the trial you can keep using the free version. On phones and tablets, one short rewarded ad you choose to watch unlocks three hours of use. On Android TV there are no ads; you choose "Limited access" and keep using the free version. The TV remote is always free, with no ads and no time limit. Some features, such as queues, playing the next item automatically, photo slideshows, more than two network sources or profiles and the app lock, need Pro. We may change what the free version includes.

When your time ends. When your three hours of free access end, the App asks you to watch another ad or buy Pro before you start a new cast. What is already playing on your TV is not interrupted, and you can keep controlling it. Pro users are never asked to watch ads.

Pro subscriptions. Pro is available as a monthly or yearly subscription sold through Google Play. Prices are shown in the App and on Google Play before you buy, in your local currency and including any taxes Google Play applies.

Subscriptions renew automatically at the end of each billing period, at the price in effect at that time, until you cancel.
You can cancel at any time in Google Play → Payments & subscriptions → Subscriptions. Cancellation takes effect at the end of the current billing period, and you keep Pro until then.
Introductory offers, where shown, are available only to users Google Play determines to be eligible. They switch to the regular price when the offer period ends.
If we change a subscription price, Google Play notifies you in advance as its policies require, and you can cancel before the new price applies.

Lifetime purchase. The Lifetime option is a one-time payment. It unlocks Pro on the Google Play account used to buy it for as long as we continue to offer the App and its Pro features. "Lifetime" means the lifetime of the App, not of a person or a device. It is personal, cannot be transferred and is not a subscription. Buying Lifetime does not cancel an existing subscription; cancel that separately in Google Play.

Devices. Purchases follow your Google Play account, so one Pro purchase works on your phones, tablets and Android TVs signed in with the same account. Pro is intended for personal and household use.

Refunds. Payments are processed by Google Play and are subject to the Google Play refund policies. You can request a refund through Google Play, and we may also grant refunds at our discretion. Where the law of your country gives you a right of withdrawal, that right may end once the digital service has started with your consent. Nothing in this section limits your mandatory rights as a consumer.

Changes to features. We may add, change or remove features. We will not materially reduce the core Pro features during a subscription period you have already paid for, unless the law, Google Play, a change by a device maker or security reasons require it.

7. Advertising

On phones and tablets, the free version offers optional rewarded ads supplied by third-party advertising networks. Ads are shown only when you ask for one on the Pro screen — never while you start or control a cast, never on the remote and never when the App opens. There are no banner or full-screen ads, and no ads on Android TV. We are not responsible for the content of third-party ads or for the websites and apps they lead to. Your advertising choices are described in our Privacy Policy.

8. Device Compatibility

Casting and remote control depend on devices, software and networks we do not control. Whether a file plays depends on the formats your TV or Cast device supports; some TVs do not support some video or audio formats or subtitles. Discovery may not work on guest networks, with VPNs, or on routers that isolate devices. Device makers and Google may change their devices, software or protocols at any time, and some features may stop working until we can adapt the App, if we can.

9. Acceptable Use

You agree not to:

Copy, modify, decompile, reverse-engineer or create derivative works of the App, except where the law expressly allows it
Bypass, disable or interfere with Pro checks, free-version limits, the trial, ads or security features, including by resetting the App or changing the device clock
Distribute modified versions of the App, or sell or rent access to it
Use the App to cast, share or give others access to content in breach of someone else's rights
Use the App to control devices you are not authorized to control
Use our cloud services, including sync and sending to Wavvy TV, in a way that overloads, damages or disrupts them, or access them by automated means other than the App
Use the App for any unlawful purpose

10. Our Intellectual Property and Licence

The App — including its code, design, name and logos — belongs to us and is protected by law. We grant you a personal, non-exclusive, non-transferable and revocable licence to install and use the App on devices you own or control, for personal and non-commercial use, in line with these Terms and the Google Play Terms of Service.

The App includes open-source components, such as an FFmpeg audio decoder licensed under the GNU LGPL. Those components are licensed under their own terms, which take precedence for those components.

11. Your Data

You keep all rights in your media, profiles, network sources and other information you add. Your media, cast history and paired TVs stay on your device. You allow us to store, sync and process your profiles and network sources, and to pass sign-in details to your own TV when you use "Send to Wavvy TV", only as needed to run the App for you, as described in the Privacy Policy. You can delete profiles and sources in the App at any time, and request deletion of your cloud data through our data deletion page.

12. Third-Party Services

The App relies on third-party services and devices, including Google (Play, Firebase and Google Cast), advertising networks, your TVs and Cast devices, and the websites, servers and streams you use. Those services are governed by their own terms, and we are not responsible for their availability, content or conduct. Google and the makers of your devices are not parties to these Terms.

13. Suspension and Termination

You can stop using the App at any time and request deletion of your data.

We may suspend or terminate your access to the App or its cloud features if you seriously or repeatedly breach these Terms, if the law requires it, or if we receive a valid notice that your use infringes someone else's rights. Where reasonable, we will tell you why. If we terminate your access because of a serious breach on your part, you are not entitled to a refund unless the law requires one.

We may discontinue the App or any feature. If we discontinue Pro features while your subscription is active, you can request a refund for the unused period through Google Play or by contacting us.

14. Disclaimers

The App is provided "as is" and "as available". To the fullest extent the law allows, we give no express or implied warranties, including that the App will be uninterrupted or error-free, that it will find or work with every TV, Cast device, network, file, codec, website or stream, or that the remote will keep working after a TV update.

15. Limitation of Liability

To the fullest extent the law allows:

We are not liable for content you cast or play with the App, for the acts of website operators, server operators, stream providers, device makers or other third parties, or for indirect losses such as loss of data, profit or opportunity.
Our total liability for all claims relating to the App is limited to the amount you paid for the App in the 12 months before the claim arose.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law — including liability for intent or gross negligence — or your mandatory rights as a consumer.

16. Indemnity

To the extent the law allows, you agree to cover reasonable losses and costs we incur from third-party claims caused by your unlawful use of the App or your breach of Section 4 or Section 9.

17. Changes to These Terms

We may update these Terms as the App changes or as the law requires. We will revise the "Last Updated" date, and we will notify you in the App before any material change takes effect. If you keep using the App after a change takes effect, the updated Terms apply. If you do not agree, stop using the App and, if you have a subscription, cancel it in Google Play.

18. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Rize, Türkiye have jurisdiction over disputes.

If you are a consumer, this does not take away the protection of the mandatory laws of the country where you live, or your right to go to the consumer arbitration bodies or courts that the law makes available to you.

Before starting formal proceedings, please contact us — most issues can be resolved quickly.

19. General

If any part of these Terms is found unenforceable, the rest remains in effect. If we do not enforce a provision, that does not mean we waive it. You may not transfer your rights under these Terms. We may transfer ours to a successor that continues to run the App, provided your rights are not reduced.

1. Bu Koşullar Hakkında

Bu Kullanım Koşulları ("Koşullar"), sizinle Rize, Türkiye'de bulunan Rize Teknoloji ("biz") arasında yapılmış bir sözleşmedir. Wavvy Beam uygulamasının telefon, tablet, Android TV ve diğer cihazlarda kullanımını ve bulut eşitleme, Wavvy TV Plus'a gönderme ve veri silme sayfası gibi ilgili hizmetlerini (birlikte "Uygulama") düzenler.

Uygulamayı yükleyerek veya kullanarak bu Koşulları kabul etmiş olursunuz. Kabul etmiyorsanız Uygulamayı kullanmayın.

Gizlilik Politikamız kişisel verileri nasıl işlediğimizi açıklar ve bu Koşulların bir parçasıdır. Telif Hakkı Politikamız telif hakkı şikâyetlerini nasıl ele aldığımızı açıklar.

Bu Koşulların İngilizcesi bu sayfanın yukarısında yayımlanmıştır. Ülkenizin hukuku aksini gerektirmedikçe, herhangi bir uyuşmazlık hâlinde Türkçe sürüm esas alınır.

2. Markalar ve Bağlantısızlık

Chromecast, Google Cast, Android TV ve Google TV, Google LLC'nin ticari markalarıdır. Samsung, LG ve Sony, sahiplerinin ticari markalarıdır. Wavvy Beam; Google, Samsung, LG veya Sony ile bağlantılı değildir, bu şirketler tarafından onaylanmamış veya desteklenmemektedir.

Bu adlar Uygulamada, mağaza sayfasında ve web sitemizde yalnızca uyumluluğu anlatmak için, örneğin "Chromecast ile uyumlu" biçiminde geçer. Ürün adımızın veya logomuzun parçası değildir. Cihaz, biçim, codec, protokol, sunucu ve web sitelerinin diğer adları sahiplerine aittir; bunların görünmesi, onlarla bağlantımız olduğu veya onlar tarafından desteklendiğimiz anlamına gelmez.

3. Uygulama Nedir, Ne Değildir

Wavvy Beam bir yansıtma aracı ve TV kumandasıdır. Şunları yapmanızı sağlar:

Kendi videolarınızı, müziklerinizi ve fotoğraflarınızı, seçtiğiniz web bağlantılarını ve oynatma listelerini telefonunuzdan veya tabletinizden Chromecast ve diğer Google Cast cihazlarına, DLNA/UPnP akıllı TV'lere ve Wavvy TV Plus uygulamamıza göndermek ("yansıtmak")
Uygulama içi tarayıcıda web sayfalarındaki video ve sesleri bulup yansıtmak
Bir Android TV veya Google TV'yi tuşlar, klavye ve sesle kontrol etmek
Medyayı cihazın kendisinde oynatmak

Uygulama şunlar değildir:

Uygulama içerik sağlamaz. Film, dizi, kanal, oynatma listesi, katalog veya hazır yayın içermez ve içerik bulmanıza yardım etmez.
Hiçbir medyayı barındırmaz, yüklemez, satmaz veya kontrol etmeyiz. Dosyalar kendi yerel ağınız üzerinden telefonunuzdan TV'nize paylaşılır; web bağlantıları TV'niz tarafından onları sunan web sitesinden yüklenir. Hiçbir şey sunucularımızdan geçmez.
Uygulama içi tarayıcı medya indirmez ve kopya korumasını (DRM) veya erişim kontrollerini aşmaz. YouTube desteklenmez.
TV kumandası, TV'nizin kendi kumanda protokolünü kullanır. Resmi bir Google ürünü değildir ve TV üreticiniz bu protokolü bir güncellemeyle değiştirebilir.
Pro için ödeme yapmak Uygulamanın özellikleri için ödeme yapmaktır. Herhangi bir film, dizi, kanal veya başka bir içerik satın almak anlamına gelmez.

4. İçeriğiniz ve Hukuka Uygun Kullanım

Uygulamayla yansıttığınız veya açtığınız dosyalardan, bağlantılardan, oynatma listelerinden, altyazılardan ve ağ kaynaklarından yalnızca siz sorumlusunuz. Şunları kabul edersiniz:

Yalnızca sahibi olduğunuz veya izleme ve gösterme hakkınız bulunan içeriği yansıtmak ve kullandığınız web sitelerinin ve hizmetlerin koşullarına uymak
Gerekli haklara ve lisanslara sahip olmadıkça Uygulamayı içerikleri umuma açık yerlerde, örneğin bir mağaza, kafe veya etkinlikte göstermek için kullanmamak
Yalnızca sahibi olduğunuz veya kullanma yetkiniz bulunan TV'lere, Cast cihazlarına, ağ paylaşımlarına ve sunuculara bağlanmak
Yaşadığınız yerde geçerli telif hakkı ve diğer yasalara uymak
Uygulamayı cihazlara, sunuculara veya ağlara izinsiz erişmek için kullanmamak

5. Uygunluk, Hesaplar ve Güvenlik

Uygulamayı kullanmak için en az 13 yaşında olmalısınız (ülkenizde dijital rıza yaşı daha yüksekse, o yaşta). Bulunduğunuz yerde reşit değilseniz, özellikle satın alma yapmak için ebeveyninizin veya velinizin izni gerekir.
Uygulamayı misafir olarak (otomatik olarak anonim bir hesap oluşturulur) kullanabilir veya profilleri ve ağ kaynaklarını cihazlarınız arasında eşitlemek için Google ile giriş yapabilirsiniz.
Çocuk profili ayarı, ebeveynlerin kendi cihazlarında nelerin gösterileceğini düzenlemesine yardımcı olur. Bir ebeveyn denetimi veya içerik filtreleme hizmeti değildir; çocukların ne izlediğinden siz sorumlu olmaya devam edersiniz.
Hesabınızdaki etkinlikten ve cihazınızın, Google hesabınızın, sunucu kimlik bilgilerinizin ve Wavvy TV Plus giriş bilgilerinizin güvenliğinden siz sorumlusunuz.
Yansıtma sürerken Uygulama seçtiğiniz dosyaları yerel ağınızda rastgele adreslerle paylaşır. Yansıtma, DLNA ve bazı ağ protokolleri şifresizdir; bunları güvendiğiniz ağlarda kullanın. Ağınızı ve cihazlarınızı korumak sizin sorumluluğunuzdadır.

6. Ücretsiz Deneme, Ücretsiz Sürüm, Pro ve Ödemeler

Ücretsiz deneme. Yeni kurulumlar 7 gün boyunca tam Pro erişimi alır. Ödeme kartı gerekmez ve deneme bittiğinde hiçbir ücret alınmaz. Uygulama ne kadar kaldığını gösterir. Deneme süresi cihaza ve hesabınıza bağlıdır, bu yüzden Uygulamayı yeniden kurmak süreyi baştan başlatmaz.

Ücretsiz sürüm. Deneme bittikten sonra ücretsiz sürümü kullanmaya devam edebilirsiniz. Telefon ve tabletlerde, izlemeyi seçtiğiniz kısa bir ödüllü reklam üç saatlik kullanım açar. Android TV'de reklam yoktur; "Sınırlı erişim"i seçer ve ücretsiz sürümü kullanmaya devam edersiniz. TV kumandası her zaman ücretsizdir; reklam ve süre sınırı yoktur. Oynatma sırası, sıradakine otomatik geçiş, fotoğraf slayt gösterisi, ikiden fazla ağ kaynağı veya profil ve uygulama kilidi gibi bazı özellikler Pro gerektirir. Ücretsiz sürümün kapsamını değiştirebiliriz.

Süreniz dolduğunda. Üç saatlik ücretsiz erişiminiz bittiğinde Uygulama, yeni bir yansıtma başlatmadan önce yeni bir reklam izlemenizi veya Pro satın almanızı ister. TV'nizde o sırada oynayan içerik kesilmez ve onu kontrol etmeye devam edebilirsiniz. Pro kullanıcılarından asla reklam izlemeleri istenmez.

Pro abonelikleri. Pro, Google Play üzerinden satılan aylık veya yıllık abonelik olarak sunulur. Fiyatlar satın almadan önce Uygulamada ve Google Play'de, yerel para biriminizde ve Google Play'in uyguladığı vergiler dahil olarak gösterilir.

Abonelikler siz iptal edene kadar her fatura döneminin sonunda, o sırada geçerli fiyattan otomatik olarak yenilenir.
İstediğiniz zaman Google Play → Ödemeler ve abonelikler → Abonelikler bölümünden iptal edebilirsiniz. İptal, mevcut fatura döneminin sonunda geçerli olur ve o zamana kadar Pro sizde kalır.
Gösterildiği durumlarda tanıtım teklifleri yalnızca Google Play'in uygun gördüğü kullanıcılara sunulur. Teklif süresi bitince normal fiyata geçilir.
Bir abonelik fiyatını değiştirirsek Google Play, politikalarının gerektirdiği şekilde sizi önceden bilgilendirir ve yeni fiyat uygulanmadan önce iptal edebilirsiniz.

Ömür boyu satın alma. Ömür boyu seçeneği tek seferlik bir ödemedir. Pro'yu, satın almada kullanılan Google Play hesabında, Uygulamayı ve Pro özelliklerini sunmaya devam ettiğimiz sürece açar. "Ömür boyu", bir kişinin veya cihazın değil Uygulamanın ömrü anlamına gelir. Kişiseldir, devredilemez ve abonelik değildir. Ömür boyu satın almak mevcut bir aboneliği iptal etmez; onu Google Play'den ayrıca iptal edin.

Cihazlar. Satın almalar Google Play hesabınıza bağlıdır; tek bir Pro satın alması, aynı hesapla giriş yapılmış telefonlarınızda, tabletlerinizde ve Android TV'lerinizde çalışır. Pro kişisel ve ev içi kullanım içindir.

İadeler. Ödemeler Google Play tarafından işlenir ve Google Play iade politikalarına tabidir. Google Play üzerinden iade talep edebilirsiniz; biz de takdirimize bağlı olarak iade yapabiliriz. Ülkenizin hukuku size cayma hakkı tanıyorsa, bu hak dijital hizmet sizin onayınızla başladığında sona erebilir. Bu bölümdeki hiçbir şey tüketici olarak sahip olduğunuz zorunlu hakları sınırlamaz.

Özelliklerdeki değişiklikler. Özellik ekleyebilir, değiştirebilir veya kaldırabiliriz. Yasa, Google Play, bir cihaz üreticisinin yaptığı değişiklik veya güvenlik gerekçeleri zorunlu kılmadıkça, ödemesini yaptığınız bir abonelik dönemi içinde temel Pro özelliklerini esaslı biçimde azaltmayız.

7. Reklamlar

Telefon ve tabletlerde ücretsiz sürüm, üçüncü taraf reklam ağlarının sağladığı isteğe bağlı ödüllü reklamlar sunar. Reklam yalnızca siz Pro ekranında istediğinizde gösterilir; yansıtmayı başlatırken veya kontrol ederken, kumandada ve Uygulama açılırken asla gösterilmez. Banner veya tam ekran reklam yoktur, Android TV'de hiç reklam yoktur. Üçüncü taraf reklamların içeriğinden veya yönlendirdikleri web sitelerinden ve uygulamalardan sorumlu değiliz. Reklam tercihleriniz Gizlilik Politikamızda açıklanmıştır.

8. Cihaz Uyumluluğu

Yansıtma ve kumanda, kontrolümüzde olmayan cihazlara, yazılımlara ve ağlara bağlıdır. Bir dosyanın oynayıp oynamayacağı, TV'nizin veya Cast cihazınızın desteklediği biçimlere bağlıdır; bazı TV'ler bazı video, ses veya altyazı biçimlerini desteklemez. Misafir ağlarda, VPN açıkken veya cihazları birbirinden yalıtan modemlerde cihaz bulma çalışmayabilir. Cihaz üreticileri ve Google cihazlarını, yazılımlarını veya protokollerini her an değiştirebilir; bu durumda bazı özellikler, Uygulamayı uyarlayana kadar (uyarlayabilirsek) çalışmayabilir.

9. Kabul Edilebilir Kullanım

Şunları yapmamayı kabul edersiniz:

Yasanın açıkça izin verdiği durumlar dışında Uygulamayı kopyalamak, değiştirmek, kaynak koda dönüştürmek, tersine mühendislik yapmak veya türev çalışmalar oluşturmak
Pro kontrollerini, ücretsiz sürüm sınırlarını, deneme süresini, reklamları veya güvenlik özelliklerini atlatmak, devre dışı bırakmak veya bunlara müdahale etmek; buna Uygulamayı sıfırlamak veya cihaz saatini değiştirmek de dahildir
Uygulamanın değiştirilmiş sürümlerini dağıtmak veya Uygulamaya erişimi satmak ya da kiralamak
Uygulamayı başkalarının haklarını ihlal ederek içerik yansıtmak, paylaşmak veya başkalarının erişimine açmak için kullanmak
Uygulamayı kontrol etme yetkiniz olmayan cihazları kontrol etmek için kullanmak
Eşitleme ve Wavvy TV'ye gönderme dahil bulut hizmetlerimizi aşırı yükleyecek, zarar verecek veya bozacak şekilde kullanmak ya da onlara Uygulama dışında otomatik yollarla erişmek
Uygulamayı hukuka aykırı herhangi bir amaçla kullanmak

10. Fikri Mülkiyetimiz ve Lisans

Kodu, tasarımı, adı ve logoları dahil olmak üzere Uygulama bize aittir ve yasalarla korunur. Size, Uygulamayı sahibi olduğunuz veya kontrol ettiğiniz cihazlara yüklemeniz ve kişisel, ticari olmayan amaçla, bu Koşullara ve Google Play Hizmet Şartlarına uygun olarak kullanmanız için kişisel, münhasır olmayan, devredilemez ve geri alınabilir bir lisans veririz.

Uygulama, GNU LGPL lisanslı bir FFmpeg ses çözücüsü gibi açık kaynak bileşenler içerir. Bu bileşenler kendi lisans koşullarına tabidir ve bu bileşenler bakımından o koşullar önceliklidir.

11. Verileriniz

Medyanız, profilleriniz, ağ kaynaklarınız ve eklediğiniz diğer bilgiler üzerindeki tüm haklar sizde kalır. Medyanız, yansıtma geçmişiniz ve eşleştirdiğiniz TV'ler cihazınızda kalır. Profillerinizi ve ağ kaynaklarınızı saklamamıza, eşitlememize ve işlememize, "Wavvy TV'ye gönder" özelliğini kullandığınızda da giriş bilgilerinizi kendi TV'nize iletmemize yalnızca Uygulamayı sizin için çalıştırmak üzere gerektiği kadar ve Gizlilik Politikasında açıklandığı şekilde izin verirsiniz. Profilleri ve kaynakları istediğiniz zaman Uygulama içinden silebilir, bulut verilerinizin silinmesini veri silme sayfamızdan talep edebilirsiniz.

12. Üçüncü Taraf Hizmetler

Uygulama; Google (Play, Firebase ve Google Cast), reklam ağları, TV'leriniz ve Cast cihazlarınız ile kullandığınız web siteleri, sunucular ve yayınlar gibi üçüncü taraf hizmetlere ve cihazlara dayanır. Bunlar kendi koşullarına tabidir ve bunların erişilebilirliğinden, içeriğinden veya davranışından sorumlu değiliz. Google ve cihazlarınızın üreticileri bu Koşulların tarafı değildir.

13. Askıya Alma ve Fesih

Uygulamayı istediğiniz zaman kullanmayı bırakabilir ve verilerinizin silinmesini talep edebilirsiniz.

Bu Koşulları ağır biçimde veya tekrar tekrar ihlal ederseniz, yasa gerektirirse ya da kullanımınızın başkasının haklarını ihlal ettiğine dair geçerli bir bildirim alırsak Uygulamaya veya bulut özelliklerine erişiminizi askıya alabilir ya da sonlandırabiliriz. Makul olduğu durumlarda nedenini size bildiririz. Erişiminizi sizin ağır bir ihlaliniz nedeniyle sonlandırırsak, yasa gerektirmedikçe iade hakkınız olmaz.

Uygulamayı veya herhangi bir özelliğini sonlandırabiliriz. Aboneliğiniz devam ederken Pro özelliklerini sonlandırırsak, kullanılmayan dönem için Google Play üzerinden veya bize yazarak iade talep edebilirsiniz.

14. Sorumluluk Reddi

Uygulama "olduğu gibi" ve "mevcut olduğu şekilde" sunulur. Yasanın izin verdiği en geniş ölçüde; Uygulamanın kesintisiz veya hatasız çalışacağı, her TV'yi, Cast cihazını, ağı, dosyayı, codec'i, web sitesini veya yayını bulacağı ya da onlarla çalışacağı veya kumandanın bir TV güncellemesinden sonra da çalışmaya devam edeceği dahil hiçbir açık veya zımni garanti vermeyiz.

15. Sorumluluğun Sınırlandırılması

Yasanın izin verdiği en geniş ölçüde:

Uygulamayla yansıttığınız veya oynattığınız içerikten, web sitesi ve sunucu işletmecilerinin, yayın sağlayıcılarının, cihaz üreticilerinin veya diğer üçüncü tarafların eylemlerinden ya da veri, kâr veya fırsat kaybı gibi dolaylı zararlardan sorumlu değiliz.
Uygulamayla ilgili tüm talepler için toplam sorumluluğumuz, talebin doğduğu tarihten önceki 12 ay içinde Uygulama için ödediğiniz tutarla sınırlıdır.

Bu Koşullardaki hiçbir şey, kast veya ağır kusur sorumluluğu dahil olmak üzere yasaca hariç tutulamayan veya sınırlanamayan sorumluluğu ya da tüketici olarak sahip olduğunuz zorunlu hakları hariç tutmaz veya sınırlamaz.

16. Tazminat

Yasanın izin verdiği ölçüde, Uygulamayı hukuka aykırı kullanmanızdan veya Bölüm 4 ya da Bölüm 9'u ihlal etmenizden kaynaklanan üçüncü taraf taleplerinin bize yol açtığı makul zarar ve masrafları karşılamayı kabul edersiniz.

17. Bu Koşullardaki Değişiklikler

Uygulama değiştikçe veya yasa gerektirdikçe bu Koşulları güncelleyebiliriz. "Son Güncelleme" tarihini değiştiririz ve esaslı bir değişiklik yürürlüğe girmeden önce sizi Uygulama içinde bilgilendiririz. Değişiklik yürürlüğe girdikten sonra Uygulamayı kullanmaya devam ederseniz güncel Koşullar geçerli olur. Kabul etmiyorsanız Uygulamayı kullanmayı bırakın ve aboneliğiniz varsa Google Play'den iptal edin.

18. Uygulanacak Hukuk ve Uyuşmazlıklar

Bu Koşullar Türkiye Cumhuriyeti hukukuna tabidir. Uyuşmazlıklarda Rize, Türkiye mahkemeleri ve icra daireleri yetkilidir.

Tüketiciyseniz bu, yaşadığınız ülkenin zorunlu yasalarının korumasını veya yasanın size tanıdığı tüketici hakem heyetlerine ya da mahkemelere başvurma hakkınızı ortadan kaldırmaz.

Resmî bir yola başvurmadan önce lütfen bize yazın; çoğu sorun hızla çözülebilir.

19. Genel Hükümler

Bu Koşulların herhangi bir bölümü uygulanamaz bulunursa geri kalanı yürürlükte kalır. Bir hükmü uygulamamamız, ondan vazgeçtiğimiz anlamına gelmez. Bu Koşullardan doğan haklarınızı devredemezsiniz. Biz haklarımızı, haklarınız azalmamak kaydıyla Uygulamayı işletmeye devam eden bir halefe devredebiliriz.
